Terms & Conditions

This Spanish translation is provided for convenience. If there is any conflict, the English version controls.
These Terms & Conditions ("Terms") govern your use of www.raysoldrugs.com (the "Website") and our SMS text messaging program, operated by Raysol Drugs Inc., doing business as Raysol Drugs ("we," "us," or "our"). By accessing or using the Website, or by opting in to our text messaging program, you agree to be bound by these Terms. If you do not agree, please do not use the Website or the messaging program.
1. No Medical Advice
The content on this Website is provided for general informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Nothing on the Website should be relied upon as medical or pharmaceutical advice. Always seek the advice of your physician, pharmacist, or other qualified health provider with any questions you may have regarding a medical condition or medication. Never disregard professional medical advice or delay seeking it because of something you have read on this Website. In an emergency, call 911 or seek immediate medical care.
2. Who May Use the Website
The Website is intended for use by adults. You must be at least 18 years old to opt in to our text messaging program or to submit the contact form on your own behalf. If you are acting for someone else — a parent, a caregiver, or a health care proxy — you confirm that you are authorized to do so and to give the consents described in these Terms on their behalf.
3. Use of the Website
You agree to use the Website only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use of the Website. You agree not to attempt to gain unauthorized access to any part of the Website or its systems.
When you contact us — through the Website, by text message, by phone, or at the pharmacy — we ask that you communicate respectfully and give us accurate information. Abusive, threatening, harassing, or discriminatory conduct toward our staff or other customers is not acceptable.
4. SMS / Text Messaging Program Terms
By opting in to the Raysol Drugs SMS text messaging program, you agree to these messaging terms:
- Program description. We send notifications that a prescription refill is ready, as well as individual customer-care messages, such as replies to questions you send us and updates about your prescriptions or account.
- Message frequency. Message frequency varies based on your prescription activity and any questions you send us.
- Cost. Message and data rates may apply. Check with your mobile carrier for details.
- Opt-out. Reply STOP at any time to cancel. You will receive one confirmation message and then no further messages.
- Help. Reply HELP for assistance, or contact us using the details below.
- Carriers. Mobile carriers are not liable for delayed or undelivered messages.
- Consent. Consent to receive text messages is not a condition of purchasing any goods or services. See our Privacy Policy for how we handle your information.
5. Prescriptions, Equipment, and Insurance
We strive to keep information about our products and services accurate and up to date, but we do not warrant that such information is complete, current, or error-free. Availability of any product or service may change without notice.
Under federal law, prescription medications cannot be returned or resold once they have left the pharmacy.
Insurance coverage. What your plan covers, and what you owe, is determined by your insurer and your plan, not by us. Any estimate we give you is an estimate only and is not a guarantee of coverage or of a final amount. Medical equipment may require a valid prescription and prior authorization, and rentals are subject to a separate rental agreement provided at the time of fitting.
6. Intellectual Property
The Raysol Drugs name, logo, and all content on the Website — including text, graphics, photographs, and product information — are the property of Raysol Drugs Inc. or its licensors and are protected by applicable intellectual property laws.
The software that runs this Website is the property of Elvin Lucero, doing business as ElvinCodes, and is licensed to Raysol Drugs Inc. for use on this Website. It is not part of the content described above and is not licensed to visitors.
You may view, download, and print pages of the Website for your own personal, non-commercial use — for example, to keep our hours or a product list to hand. Any other use, including reproduction, modification, distribution, republication, or use of our name or logo in connection with another business, requires our prior written permission.
7. Right to Refuse or Discontinue Service
To protect our staff and our customers, we reserve the right to refuse, limit, or discontinue service to anyone whose conduct violates these Terms. Nothing in this section affects a pharmacist's professional and legal obligations, including the obligation to refuse to fill a prescription where the law or professional judgment requires it.
8. Disclaimer of Warranties
The Website is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Website will be uninterrupted, secure, or error-free.
9. Limitation of Liability
To the fullest extent permitted by law, Raysol Drugs Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Website or the SMS program. Some jurisdictions do not allow the exclusion or limitation of certain damages, so parts of this section may not apply to you.
10. Third-Party Links
The Website may contain links to third-party websites that are not operated by us. We are not responsible for the content, policies, or practices of any third-party sites.
11. Changes to These Terms
We may revise these Terms at any time. The most current version will always be posted on this page with an updated "Last updated" date. If a change is material, we will post it at least 30 days before it takes effect. Your continued use of the Website after that date constitutes acceptance of the revised Terms.
12. Governing Law and General Terms
These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any dispute arising out of these Terms or your use of the Website shall be brought in the state or federal courts located in New York County, New York.
If we do not enforce a right or provision of these Terms, that is not a waiver of it. If any provision is held invalid or unenforceable, the rest remain in effect. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Website and the messaging program, and replace any earlier understanding about them. They do not replace or change any separate agreement you sign with the pharmacy, such as a rental agreement for medical equipment.
