This Privacy Policy describes how Raysol Drugs Inc., doing business as Raysol Drugs ("we," "us," or "our"), collects, uses, and protects information when you visit www.raysoldrugs.com (the "Website") or participate in our SMS text messaging program. By using the Website or opting in to receive text messages, you agree to the practices described in this policy.
1. Scope of This Policy
Raysol Drugs is a licensed pharmacy and a health care provider. This Privacy Policy applies only to information we collect through the Website and our SMS text messaging program.
It does not cover your health information. Information about your prescriptions, your health conditions, your insurance claims, and the medical equipment we supply to you is protected health information under the federal Health Insurance Portability and Accountability Act (HIPAA) and under New York State law. We handle that information under our HIPAA privacy practices, not under this policy. Those practices are set out in our Notice of Privacy Practices, and we will give you a paper copy on request at the counter.
Please do not send prescription details, diagnoses, or other health information through the contact form on this Website or by email. Those channels are not secure. If you need to discuss your prescriptions or your care, call us or speak to us at the counter.
2. Information We Collect
Information you provide. If you contact us through the Website (for example, by our contact form, email, or phone), or opt in to our text messaging program, we may collect information such as your name, email address, mobile phone number, and the contents of your message.
Text messaging program. If you opt in, we collect your name, your mobile phone number, your mobile carrier, the date, time, and content of messages between you and us, and your opt-in and opt-out preferences. We use this information to operate the messaging program and for no other purpose.
Information collected automatically. Like most websites, we may automatically collect limited technical information such as your IP address, browser type, device information, referring pages, and how you interact with the Website.
3. How We Use Your Information
We use the information we collect to:
- Respond to your inquiries and provide customer service;
- Send text messages you have requested (see "SMS / Text Messaging" below);
- Operate, maintain, and improve the Website;
- Monitor and analyze usage and trends; and
- Comply with legal obligations.
4. SMS / Text Messaging
Raysol Drugs offers an SMS text messaging program. Participation is optional and requires your express opt-in consent, which you may provide through our contact form or by another method we make available. Consent to receive text messages is not a condition of purchasing any goods or services.
Types of messages. If you opt in, you may receive notifications that a prescription refill is ready, as well as individual customer-care messages, such as replies to questions you send us and updates about your prescriptions or account.
Message frequency. Message frequency varies based on your prescription activity and any questions you send us. Message and data rates may apply.
Opt-out and help. You can cancel the SMS service at any time by replying STOP. After you send STOP, we will send a confirmation message and then stop sending SMS messages. For help, reply HELP or contact us using the information below.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors who support our services (such as messaging platform providers) is limited to what is needed to deliver the service. Text messaging originator opt-in data and consent are not shared with any third parties for any other purpose.
5. Cookies, Analytics, and Do Not Track
We do not set cookies of our own, and the Website uses no analytics or advertising services. It stores one item in your browser's local storage: the language you choose with the English / Spanish switch, so the Website remembers it on your next visit. That stays on your device and is not sent to us, and you can clear it through your browser settings. If we ever add cookies or analytics of our own, we will update this policy to say what they are.
The map on our Contact page. That page embeds a Google map so you can see where we are. When the map loads, Google receives your IP address and may set its own cookies on your device. That collection is Google's, under Google's privacy policy, and not something we control or receive. No other page on the Website loads anything from a third party.
Do Not Track. Some browsers can send a "Do Not Track" signal. There is no common standard for how websites should respond to those signals, and this Website does not respond to them. Because we do not track visitors across other websites, there is nothing for the signal to switch off.
6. How We Share Information
We do not sell your personal information, and we do not share it for targeted advertising. We may share information with service providers who help us operate the Website and messaging program, or where required by law, legal process, or to protect our rights and the safety of others. As stated above, mobile opt-in data is never shared with third parties for marketing purposes.
7. Data Security
We take reasonable measures to protect the information collected through the Website. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.
8. How Long We Keep Information
We keep information collected through the Website and the messaging program for as long as we need it for the purposes described in this policy, and then for any further period the law requires. Contact form submissions and email correspondence are kept for as long as we need them to answer you and to keep a record of the exchange. Text messaging opt-in and opt-out records are kept while you are enrolled and afterward for as long as we are required to be able to show your consent. Records we hold as your pharmacy are kept for the periods required by federal and New York State pharmacy law, which are longer.
9. Third-Party Links
The Website may contain links to third-party websites. We are not responsible for the privacy practices or content of those sites and encourage you to review their privacy policies.
10. Children's Privacy
The Website is not directed to children under the age of 13, and we do not knowingly collect personal information from children. You must be at least 18 years old to opt in to our text messaging program or to submit the contact form on your own behalf.
11. Your Rights and Choices
Depending on where you live, you may have the right to ask us for a copy of the personal information we hold about you, to have it corrected, or to have it deleted, and to appeal if we turn a request down.
Separately, HIPAA gives you rights in the health information we hold as your pharmacy. Those include the right to see and get a copy of your records, to ask us to correct them, to receive a list of certain disclosures we have made, and to ask us to communicate with you by a particular method or at a particular address. Those requests are handled at the pharmacy, not through this Website.
To make a request about information covered by this policy, contact us using the details below. We may need to verify your identity before we act on it, and we may ask you for enough detail to understand what you are asking for. We will respond within the time the applicable law allows, and we will not treat you differently for making a request. To stop text messages, reply STOP to any message from us.
12. Complaints
If you are concerned about how we have handled your information, contact us using the details below and we will look into it. If your concern is about health information protected by HIPAA, you may also file a written complaint with the U.S. Department of Health and Human Services, Office for Civil Rights. We will not retaliate against you for making a complaint.
13. Changes to This Policy
We may update this Privacy Policy from time to time. Changes will be posted on this page with an updated "Last updated" date.
